These Terms of Service (the "Terms") are a binding contract between you and QUIET PRAYERS LLC. ("Prayible," "we", "us", "ours"). Your use of the Services in any way means that you agree to all of these Terms, and these Terms will remain in effect while you use the Services. These Terms include the provisions in this document as well as those in the Privacy Policy, Cookie Policy and Copyright Dispute Policy. Please read these Terms carefully, and if you're under 18, please make sure to read these Terms with a parent or guardian.

You understand and agree that the Services and any information you learn from Prayible are not intended, designed, or implied to diagnose, prevent, or treat any condition or disease, to ascertain the state of your mental or physical health, or to be a substitute for professional medical, psychological, or psychiatric care. Not all activities described in the Services are suitable for everyone. You understand and agree that you are solely responsible for your use of the Services.

 

1. Changes to the Terms

We are constantly trying to improve our Services, so these Terms may need to change along with our Services. We reserve the right to change the Terms at any time, but if we do, we will place a notice on our Site, send you an email, and/or notify you by some other means. Unless we state otherwise, changes to our Terms are effective when posted.

If you don't agree with the new Terms, you are free to reject them; unfortunately, that means you will no longer be able to use the Services. If you use the Services in any way after a change to the Terms is effective, that means you agree to all of the changes.

3. Using the Services

To access certain features of the Services, you may be required to sign up for an account ("Account"), select a password and user name ("Prayible User ID"), and provide us with certain information, such as:

• If you are seeking prayer services: your contact information and faith preferences

• If you are offering prayer services as a guide: your contact information, faith background, and any relevant qualifications

You promise to provide us with accurate, complete, and updated registration information. You may not select as your Prayible User ID a name that you don't have the right to use, or another person's name with the intent to impersonate that person. You may not transfer your account to anyone else without our prior written permission.

You will use the Services only for their intended purposes:

• To connect with prayer guides and other users for prayer services

• To offer prayer services if you are a qualified guide

• To participate in virtual or in-person prayer sessions

• To make or receive payments for prayer services

 

4. User Categories and Responsibilities

Our Services have two main categories of users:

Prayer Service Users may:

• Book prayer sessions with guides

• Participate in individual or group prayer sessions

• Pay for prayer services

• Provide feedback and ratings for guides

• Connect with other users for group prayer

Prayer Guides may:

• Offer prayer services within their faith tradition

• Set availability and pricing for their services

• Conduct individual or group prayer sessions

• Receive payments for their services

• Build a profile showcasing their background and qualifications

Both categories of users must:

• Provide accurate information about themselves

• Respect the faith traditions and beliefs of others

• Maintain appropriate boundaries in all interactions

• Use the video conferencing features responsibly

• Comply with all payment terms and conditions

 

5. Payment Terms

Payment terms for prayer services:

• All payments are processed through our authorized payment processors (Stripe, Apple, Google)

• Guides set their own rates for services

• Users pay for services at the time of booking

• Prayible may charge a platform fee for facilitating the connection

• Refunds are handled according to our refund policy

• Payment disputes must be raised within 30 days of the service

 

6. Video Sessions

Our platform enables virtual prayer sessions through video conferencing technology. When participating in these sessions, you agree to conduct yourself with the same respect and dignity you would bring to an in-person prayer service. Recording or storing video sessions is strictly prohibited unless you have obtained explicit written consent from all participants beforehand. While we strive to provide reliable video functionality, the quality of sessions may vary based on your internet connection and device capabilities. You are responsible for ensuring your equipment meets the minimum technical requirements for video participation, which you can find on our Support page. Though we work to maintain stable video services, Prayible cannot guarantee uninterrupted service or be held responsible for technical issues beyond our reasonable control.

 

7. Content and Licenses

Everything you see or experience through our Services, including text, graphics, images, icons, and video content (collectively, "Content") is protected by copyright and other intellectual property laws. This protection extends to both Prayible's Content and content generated by our users.

When you create content through our Services—whether that's your profile information, prayer requests, messages with guides, feedback, or any other material (collectively, "User Submissions")—you retain your rights to that content. However, by sharing it through our platform, you grant Prayible a license to display, perform, and distribute your User Submissions solely for the purpose of providing and improving our Services. This license allows us, for example, to share your prayer request with a guide, display your feedback to other users, or use your suggestions to enhance our platform. When you provide User Submissions, you represent and warrant that you have all necessary rights to grant us this license without violating any third-party rights.

 

8. Prohibited Conduct

Our Services are designed to foster meaningful prayer connections in a safe, respectful environment. To maintain this environment, certain conduct is strictly prohibited. You may not use our Services for any illegal purpose, nor to harass, abuse, or harm others. Impersonation of any person or entity is prohibited, as is sharing your account credentials with others. We take the sacred nature of prayer seriously; therefore, any attempt to exploit the platform for commercial purposes beyond the authorized offering of prayer services is not permitted. You may not collect information about other users without their permission, attempt to breach our security measures, or engage in any activity that could compromise the sanctity of prayer sessions or the safety of our users.

 

9. Termination

While we hope your experience with Prayible will be long and meaningful, we reserve the right to suspend or terminate your access to our Services if necessary. This might occur if you violate these Terms, engage in conduct that creates legal exposure for Prayible, leave your account inactive for an extended period, or for other reasons we determine in our sole discretion. Similarly, you may choose to terminate your account at any time through your account settings or by contacting our support team. If you do decide to leave our platform, we will handle any remaining obligations (such as pending payments) according to these Terms before closing your account.

 

10. Disclaimers and Limitations of Liability

Our Services are provided "as is," without any warranties of any kind. While we strive to create a meaningful platform for prayer connections, there are certain things we cannot guarantee or be responsible for. It's important to understand that Prayible is not a religious organization and we are not affiliated with any religious denomination. We don't provide medical, psychological, or professional counseling services, nor can we guarantee any particular outcome from prayer services.

We work hard to maintain a safe and functional platform, but we cannot be liable for certain types of damages or situations. These include indirect or consequential damages, privacy breaches caused by other users, actions taken by guides or users on the platform, technical failures during video sessions, or any claims exceeding what you've paid to Prayible in the past six months. This limitation of liability helps us continue to offer our Services while protecting our ability to operate responsibly.

 

11. Dispute Resolution

We hope that any disagreements can be resolved informally through good faith discussions. However, if a formal dispute arises, it will be resolved through binding arbitration in [jurisdiction]. This means that disputes will be handled outside of court, except for small claims court cases, intellectual property disputes, or situations requiring emergency injunctive relief.

By using our Services, you agree to waive certain rights, including the right to a jury trial, the right to participate in a class action lawsuit, and claims for punitive damages. We believe this arbitration agreement provides a fair and efficient way to resolve disputes while keeping costs reasonable for all parties involved.

 

12. Faith-Based Content and Religious Freedom

Prayible serves as a platform to connect those seeking prayer with those offering prayer services, but we do not endorse any particular faith, religion, or belief system. We are committed to creating a space where all faiths are respected and welcomed. While we encourage sharing and learning between different faiths, we strictly prohibit any attempts at proselytizing or forced conversion. We maintain neutrality in religious matters while fostering an environment of mutual respect and understanding. Content that disparages any faith tradition or attempts to promote religious intolerance has no place on our platform and will be removed.

 

13. International Use

Our Services are operated from servers in the United States, but we welcome users from around the world. When you use our Services from outside the United States, you're still responsible for complying with both U.S. laws and your local laws regarding online conduct and the provision or receipt of prayer services. While we strive to make our Services available internationally, we make no special representations about the appropriateness or availability of our Services in any particular location. If you're using our Services from outside the United States, you should understand that your personal data will be transferred to and processed in the United States, and that payment processing, including currency conversion rates and fees, will be handled by our third-party payment processors according to their terms of service.

 

14. Refunds

Any services provided by prayer guides are their own work product; we don’t control it or decide what to charge or any other aspect of their services.  As such, prayer guides determine entirely on their own how to manage your request or participation in their sessions. 

 

If you cannot participate in a session you paid for because of a technical error on our part, we’ll make sure that you’re refunded via the prayer guide.  But we cannot and do not make any other promises or representations about refunds for sessions beyond that we will always pass along any requests for refunds that we receive onto the relevant prayer guide.  What happens from there is up to you and the prayer guide to resolve: we have no other role in the process.

 

15. Miscellaneous

These Terms constitute the complete and exclusive understanding between you and Prayible regarding the Services, superseding any prior agreements or understandings. If any provision of these Terms is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full effect. Our failure to enforce any right or provision of these Terms won't be considered a waiver of that right or provision.

You may not assign or transfer your rights under these Terms without our prior written consent, but we may assign our rights under these Terms without restriction. Any attempted transfer or assignment in violation of this section is void. Nothing in these Terms shall create an employment, agency, partnership, or joint venture relationship between you and Prayible.

If you continue to use the Services after the changes become effective, you agree to be bound by the revised Terms. 1.1 This is the Privacy Policy for Prayible, but we'll refer to ourselves as "Prayible," or "the Company," or use "we/us/our" pronouns.

1.2 We have a Privacy Policy for a few reasons. First, it's required by law. Second, and more importantly, we want you to understand how we use data so you can make an informed decision about how you share with us, what you share with us, and how we use your information. Finally, our Privacy Policy sets internal rules for how we use data and it holds us accountable: if we don't tell you what we're doing here, in the Privacy Policy, we won't do it at all unless we specifically obtain your permission.

1.3 We want this Privacy Policy to be understandable on its own, but there are concepts, terms, and phrases that have specialized meaning because they come directly from privacy laws. You can look at the "Further Reading" section to get a clearer idea of what these terms mean.

1.4 We operate in more than one country and specific laws in many places require that specific things are included within a privacy policy. We believe that including all these requirements throughout a privacy policy makes it harder for normal people to read. As such, we made the decision to write this Privacy Policy in the clearest way that we can and included the specific international legal requirements in the "International Rights" section at the end of this Privacy Policy.

2. Information About Prayible and this Privacy Policy

2.1 This Privacy Policy outlines how Prayible collects and processes your personal data through your use of Prayible's website, app, or any other services sponsored or controlled by Prayible. In other words, if we're collecting personal data in any form, this Privacy Policy applies.

2.2 Along those lines, Prayible is the "Controller" of the personal data it collects, which means we are the entity that decides how to collect, process, and use the personal data.

2.3 We'll provide links to this Privacy Policy wherever we can -- on our websites, in the app, or anywhere else we collect data. You should read this Privacy Policy, think about it, ask questions, and decide if you're comfortable with it. Also read our Terms and Conditions, which control how we provide our services, and any other notices or policies we post, so that you can make an informed decision about interacting with us.

2.4 When we make a change to this Privacy Policy, we'll post a notice for you to review. This Privacy Policy was last changed on November 15, 2024.

3. What Data Are We Collecting About You?

3.1 Not all data is "personal data" under the law, but a lot of it is, and more than you might think. And so, for Prayible's purposes, personal data is:

Any information that can, either alone or with other information, be used to identify an actual human person or their household.

3.2 These are the categories of personal data that we collect:

• "Basic Data" means your name, your email address, your physical address, your phone number, your gender identification, and your verified age. Basic Data is collected only if you elect to provide it to Prayible in the course of using the Prayible website or app. You may be required to provide Basic Data to use some of Prayible's services, such as booking prayer services or creating a guide profile.

• "Faith Data" means information related to your religious or spiritual preferences, practices, and beliefs that you choose to share with us. This includes your preferred faith traditions, prayer preferences, and any faith-related information you provide when booking or offering prayer services. Faith Data is collected only when you voluntarily provide it, and we treat this as sensitive personal information with additional protections.

• "Profile Data" means the detailed information you've set up and shared with us as either a user seeking prayer services or as a guide offering them. Your profile data includes your account ID, password, activity while logged in (including bookings, reviews, ratings, notes, and feedback), and any other information you choose to share in your profile. Profile Data is collected only if you elect to provide it to Prayible.

• "Payment Data" means credit card or payment information processed through our payment providers (Apple, Google, or Stripe) when you make or receive payments for prayer services. We do not store your payment information directly - it is handled entirely by our payment processors.

• "Technical Data" means any information we collect as we operate our websites and apps, like your IP address when you connect to our websites, your mobile device identifier, what browser you used to access our site and what operating system you're using, the movement of your mouse on the screen (mouse hovers and clicks), and the length of time you spend on our website or app.

• "Usage Data" means information about how you use our services, including which prayer services you book or offer, your participation in prayer sessions, and your interactions with other users through the platform.

• "Communication Data" means any messages, feedback, or other communications between users and guides, as well as any communications with our customer support team.

• "Video Data" means any audio, video, or audio-visual content created during virtual prayer sessions, including live video and audio streams, technical information about the video call (duration, quality, participants), and chat messages or other interactions that occur during video sessions. Video Data is collected only during virtual prayer sessions and is processed through secure video service providers to facilitate live connections between users and guides.

3.3 As explained below, we may combine different kinds of personal data in the performance of our services. We'll also sometimes combine the personal data you've given us with non-personal data. If the combined data can identify you, we'll treat it like personal information, even though some parts of the combined data can't identify you.

3.4 Unless you've provided us with informed consent, we will not solicit any sensitive categories of personal data about you beyond Faith Data. This includes details about your race or ethnicity, political opinions, trade union membership, information about your health and genetic and biometric data, or information about criminal convictions or offenses.

4. How We Collect Personal Data

We collect personal data in a variety of ways, depending on how you interact with us, including:

4.1 Direct interactions. You may give us your Basic, Faith, Profile, Payment, Usage, Communication, or Video Data by interacting with us, as when you:

• create an account on our platform;

• register as a prayer guide;

• book or provide prayer services;

• participate in virtual prayer sessions;

• make or receive payments for services;

• communicate with other users or guides;

• contact customer support;

• sign up to receive information from us;

• provide feedback or reviews; or

• apply for a position with us.

4.2 Through automated technologies or interactions. As you interact with our website or app, we automatically collect Technical Data about your equipment, browsing actions, and patterns. 4.3 From third parties. We may receive personal data about you from various third parties, including:

• Our payment processors (Stripe, Apple, Google) when you make or receive payments

• Our video service providers when you participate in virtual prayer sessions

5. Why (and How) We Use Personal Data

5.1 We will only use your personal data when we have a lawful justification for doing so. In some situations, the only lawful justification for using your personal data is when you provide us with your consent. If you ever give us your consent to use your personal data, don't worry - you can change your mind and withdraw your consent at any time.

5.2 The following list sets out how we use personal data, and the lawful basis for doing so:

• Providing our core services. We need Basic Data, Faith Data, Profile Data, and Payment Data to connect users with guides, facilitate prayer services, and process payments. We need this information to fulfill our contract with you, and so collecting this data is necessary to provide our services.

• Enabling virtual prayer sessions. We use Video Data and Technical Data to facilitate online prayer sessions between users and guides. We need this information to fulfill our contract with you and provide the services you've requested.

• Supporting our community. We use Communication Data to enable interactions between users and guides, maintain community standards, and provide customer support. We have a legitimate interest in maintaining a safe and supportive prayer community.

• Processing payments. We use Payment Data to process payments between users and guides through our payment providers. We need this information to fulfill our contract with you and facilitate payments for services.

• Improving our services. We use Technical Data and Usage Data to analyze how people use our platform, identify areas for improvement, and enhance the user experience. We have a legitimate interest in making our services better.

• Maintaining security. We'll use Technical Data and Usage Data to keep our platform secure, prevent fraud, and protect our users. We have a legitimate interest in protecting our community and services.

5.3 We will only keep your personal data for as long as necessary under the circumstances in which we collected it, including our obligation to hold onto it for legal, regulatory, or accounting purposes. If we are able to make data completely anonymous (that is, it can't be used to identify you), we may keep that data indefinitely for statistical or analytic purposes.

6. Data Security

6.1 We work hard to keep your data (and ours) safe. We use a variety of tools -- technological, administrative, and physical -- to keep data secure. These safeguards are designed to ensure that whatever personal data we keep is protected against unlawful access or use. Despite our best efforts, however, no security measures are completely impenetrable. We pay special attention to protecting Faith Data, treating it with additional security measures appropriate to sensitive personal information.

6.2 We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

7. Data Disclosure

7.1 Sometimes, we will share your personal data with:

• Service providers. We use outside vendors and service providers to enable our company to function. • Other users. To provide our services, we need to share some of your data with other users of the platform: ◦ If you're a user seeking prayer services, guides will see your Basic Data and Faith Data related to your service request ◦ If you're a guide offering services, users will see your profile information and faith-related offerings ◦ During video sessions, participants will see your Video Data

• Regulators. If we are subject to an audit, review, or other inquiry by a properly constituted regulatory agency, they may require us to share the data we have, including personal data.

• Legal demands. We have to comply with lawful subpoenas or investigative demands from courts and law enforcement agencies. We want to be really transparent on this point: if law enforcement (or anyone else with a valid subpoena) follows the correct legal process and demands information from Prayible, we have to share that information.

7.2 We share your personal data with third parties only to enable us to fulfill our contract with you, because you have consented to it, or because it's necessary for a legal or regulatory requirement. None of these third parties are allowed to use your personal data in any way that is different from the reasons we outline here.

8. Marketing our Services

8.1 We may use your Basic Data and Usage Data to send you information about services we think you might like, new features, or other updates about Prayible. The most important part in all of this: you have absolute control over how, and if, we market to you. You can always decide how much information you share and how we contact you when it comes to marketing.

8.2 Opting out You can ask us to stop sending you marketing messages at any time by:

• Following the opt-out links on any marketing message sent to you

• Contacting us at any time

Where you opt out of receiving marketing messages, this will not apply to necessary service communications about your account or prayer services.

9. Your Rights

9.1 When you provide us with personal data, you have rights about how we use it, and why. Although the laws are sometimes different based on your location, generally speaking, no matter where you are, you have the right to:

• Request access to your personal data

• Request correction of your personal data

• Request erasure of your personal data

• Object to processing of your personal data

These rights may vary depending on where you live, but we'll always provide the highest level of data rights protection available under applicable law.

9.2 No fee usually required You don't have to pay a fee to exercise these rights. However, we may charge a reasonable fee if your request is clearly unfounded, repetitive, or excessive.

9.3 What we may need from you We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it.

9.4 Time limit to respond We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

10.1 We are based in the United States and will transfer data from other parts of the world as outlined in this Privacy Policy.

10.2 Whenever we transfer your personal data internationally, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:
